If you are outside the United States: The arbitration will be conducted in accordance with the Rules for Non-Administered Arbitration of the International Institute for Conflict Prevention and Resolution (“Rules”) then in effect. The arbitration will be conducted before a panel of three arbitrators selected using the screened process provided in the Rules. The arbitration shall be seated and take place in New York, New York. The arbitration panel, and not any federal, state or local court or agency, shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability or formation of this Agreement. The arbitration panel shall have no power to award non-monetary or equitable relief of any sort. Notwithstanding anything to the contrary in this Section, you or Marine Essence may elect to pursue a claim in small claims court rather than arbitration by providing the other party with notice of your or Marine Essence’s intention to do so within thirty (30) days of the time the claim arises. The small-claims court proceeding will be limited solely to your or Marine Essence’s individual dispute or controversy.
This arbitration clause shall survive the termination of these Terms of Use. If this specific provision is found to be unenforceable, then (a) the entirety of this arbitration provision shall be null and void, but the remaining provisions of these Terms of Use shall remain in full force and effect; and (b) exclusive jurisdiction and venue for any claims will be as set forth in Section 26.
